Shea beer vendor loses age-discrimination claim

New York MetsAn octogenarian beer vendor transferred to a less lucrative stand at Shea Stadium lost her claim of age discrimination after an appeals court found that being replaced by a 75-year-old beer vendor did not rise to the level of bias.

Mildred Block, now 86 years old, filed a claim of age discrimination after she was transferred to a new stand in 2008 and her 40-year-old partner in the beer stand was not. Concessionaire Aramark said performance, not her age, was the issue: fans complained of the long lines at the stand.

She appealed the decision after the city’s Human Rights Commission ruled in Aramark’s favor.
